1. Overview

This website is operated by Prime Sports. Throughout these Terms of Service, the words “Prime Sports,” “we,” “us,” and “our” refer to Prime Sports.

Prime Sports offers this website, including all information, products, features, tools, and services available through the website, to you conditioned upon your acceptance of these Terms of Service and all policies referenced in them.

These Terms apply to all visitors and users of our website, including customers, account holders, browsers, and anyone who purchases or attempts to purchase a product from us.

By visiting our website, creating an account, submitting an order, or otherwise using our services, you agree to these Terms of Service. If you do not agree to these Terms, you must not use the website or purchase products from us.

Our store is hosted through Shopify, which provides the online-commerce platform we use to offer and sell our products.

2. Eligibility

You must be legally capable of entering into a binding agreement to use our services or make a purchase.

Our website is not intended for children under 13. You may not provide us with personal information if you are under 13.

If applicable law requires a parent or legal guardian to authorize your purchase or use of the website, you may use our services only after receiving that authorization. By placing an order, you represent that you are legally permitted to complete the transaction and use the payment method provided.

3. Store Accounts

Customers may shop as guests or create an account when that option is available.

You are responsible for maintaining the confidentiality and security of your account credentials. You are also responsible for activity conducted through your account unless that activity resulted from circumstances outside your reasonable control.

You agree to provide current, complete, and accurate account and purchasing information. You must promptly update information when necessary so we can complete transactions and contact you regarding your orders.

You may not transfer, sell, share, or misuse your account. Contact us promptly if you believe your account or payment information has been used without authorization.

We may suspend or terminate accounts that contain false information, appear fraudulent, violate these Terms, or create a risk to Prime Sports, our customers, or other parties.

4. Products

Prime Sports sells physical sports clothing, apparel, and related merchandise.

We make reasonable efforts to display product descriptions, photographs, colors, measurements, and other details accurately. However, the appearance of a product may vary slightly because of lighting, photography, manufacturing variations, image processing, or differences between device displays.

Product images are provided for reference and may not perfectly represent every minor detail of the item received. Minor differences that do not substantially affect the product’s identity or ordinary use will not necessarily be considered defects.

Availability is not guaranteed. We may change, discontinue, limit, or update any product at any time without advance notice.

5. Product Sizing

Sizing may vary by brand, manufacturer, product type, and design. A labeled size from one product may fit differently from the same labeled size in another product.

Customers are responsible for reviewing available sizing information and selecting the correct size before placing an order. Sizing guides and measurements are informational tools and do not guarantee a particular fit.

Selecting the wrong size, preferring a different fit, or failing to review the available measurements does not qualify an order for a return, exchange, or refund.

6. Prices and Information

All prices are displayed in the currency shown during checkout. Prices, discounts, promotions, product descriptions, and availability may change at any time without notice.

We reserve the right to correct typographical mistakes, inaccurate descriptions, pricing errors, inventory errors, or omissions. If an error affects an order, we may contact you for instructions or cancel the affected order and issue any refund required.

A product appearing in a shopping cart does not reserve it or guarantee its availability. Promotions may be limited by date, inventory, location, quantity, or other conditions.

7. Orders

Submitting an order is an offer to purchase the selected products under these Terms. An automated order confirmation acknowledges that we received the order but does not necessarily mean the order has been accepted.

We may accept, decline, limit, or cancel an order when reasonably necessary. Reasons may include:

• Product or inventory unavailability

• Pricing or description errors

• Payment authorization problems

• Suspected fraud or unauthorized activity

• Resale activity

• Shipping restrictions

• Violations of these Terms

• Circumstances preventing lawful or practical fulfillment

If we cancel a paid order before shipment, we will issue an appropriate refund to the original payment method.

We may limit quantities purchased per person, household, account, payment method, billing address, or shipping address.

8. Payments

You agree to provide valid, current, and accurate billing and payment information.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize Prime Sports and its payment providers to charge the total shown during checkout.

The final charge may include the product price, shipping charges, taxes, duties, and other disclosed costs. Payment processing may be handled by Shopify or other third-party providers under their own terms and privacy practices.

If a payment is rejected, reversed, disputed, or identified as potentially fraudulent, we may delay or cancel the order.

Customers should contact us before initiating a payment dispute so we have a reasonable opportunity to investigate and resolve the issue. Nothing in this section limits any lawful billing-dispute rights.

9. Taxes, Customs, and International Orders

Customers are responsible for applicable sales, use, import, customs, value-added, and similar taxes unless they are collected during checkout.

International orders may be inspected, delayed, or assessed customs duties, brokerage costs, import taxes, or other government charges. Unless checkout expressly states otherwise, these additional charges are the customer’s responsibility.

Prime Sports does not control international customs agencies and cannot guarantee when an international package will clear customs. Refusal to pay customs charges may result in the package being delayed, abandoned, destroyed, or returned.

Customers are responsible for confirming that an ordered product may lawfully be imported into and used within the destination country.

10. Shipping and Delivery

We ship within the United States and to supported international destinations. Available destinations and shipping options may change.

Any delivery date or transit time is an estimate unless we expressly state otherwise. Delivery may be affected by carrier delays, customs processing, weather, holidays, supply issues, emergencies, incorrect address information, or other circumstances outside our reasonable control.

Customers must provide a complete and accurate shipping address. Prime Sports is not responsible for delays, losses, or additional expenses caused by incorrect or incomplete information supplied by the customer.

Once an order has shipped, changes to its address or delivery method may not be possible. The customer may be responsible for additional shipping costs when a package is returned because of an incorrect address, refusal, failed delivery, or failure to collect it.

11. Delivered, Lost, or Stolen Packages

Carrier tracking may be used as evidence that a package was delivered to the address provided during checkout.

If tracking shows delivery but you cannot locate the package, check with household members, neighbors, building staff, mailrooms, reception areas, and other secure locations. You should also contact the shipping carrier when appropriate.

We will make reasonable efforts to assist with a delivery investigation. However, we are not responsible for theft or disappearance occurring after confirmed delivery unless applicable law provides otherwise.

12. Final-Sale Policy

All sales are final except when a different remedy is required by applicable law or expressly approved by Prime Sports in writing.

We do not accept ordinary returns or exchanges and do not provide refunds for reasons including:

• Selecting an incorrect size, color, style, or quantity

• Changing your mind

• Buyer’s remorse

• Personal preferences concerning fit or appearance

• Finding a lower price elsewhere

• No longer wanting or needing the product

• Minor display or color variations

• Failure to review product information

• Normal wear and tear

• Damage occurring after delivery

Customers should review our Refund, Return, Exchange, and Damaged-Item Policy before purchasing. That policy is incorporated into these Terms by reference.

13. Damaged, Defective, or Incorrect Products

If a product arrives damaged, has a significant defect, or is materially different from the item ordered, contact us promptly at primesportss16@gmail.com.

Your message should include:

• Your name and order number

• A description of the issue

• Clear photographs of the entire item

• Close-up photographs showing the issue

• Photographs of the shipping package and label

• A video if photographs do not clearly show the problem

• Other reasonably requested information

Keep the item, tags, accessories, and original packaging until we finish reviewing the claim. Do not wear, wash, alter, repair, discard, or return the item unless we instruct you to do so.

Submitting a claim does not automatically guarantee a refund. After reviewing a valid claim, we will determine an appropriate solution based on the circumstances. A solution may include repair instructions, replacement, an available comparable item, store credit, a partial refund, a full refund, or another reasonable resolution.

Claims may be denied when damage resulted from wear, misuse, improper care, accidental damage after delivery, unauthorized alteration, or insufficient evidence.

This section does not restrict any non-waivable rights provided by applicable law.

14. Unauthorized Returns

Do not send a product back without written authorization from Prime Sports.

Unauthorized returns may be refused and may not be returned to the sender. Mailing a product to us without authorization does not create a right to a refund, exchange, replacement, or store credit.

When a return is authorized to resolve a verified problem, you must follow the instructions we provide. The returned item must include all requested components, accessories, tags, and packaging.

15. Order Changes and Cancellations

Orders may begin processing shortly after being placed. Therefore, we cannot guarantee that an order can be changed or canceled after submission.

Contact us immediately if you notice an error. We will make a reasonable effort to help, but a request is not approved unless we confirm the change or cancellation in writing.

Once processing or shipment has begun, cancellation may no longer be available.

16. Acceptable Use

You may use our website only for lawful personal or commercial-shopping purposes consistent with these Terms.

You may not:

• Use the website for unlawful, fraudulent, abusive, or deceptive purposes

• Attempt to gain unauthorized access to accounts, systems, or information

Third-party product names, team marks, manufacturer marks, and other trademarks belong to their respective owners. Their appearance does not transfer any ownership rights to you.

18. Reviews, Feedback, and Submissions

If you submit a product review, photograph, comment, suggestion, idea, or other content, you represent that you have the right to provide it and that it does not violate another person’s rights.

Submitted content must not be unlawful, threatening, defamatory, deceptive, obscene, infringing, malicious, or contain harmful code.

To the extent permitted by law, you grant Prime Sports a nonexclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute content you voluntarily submit for store-related and promotional purposes.

We may remove submitted content that violates these Terms or is otherwise inappropriate, but we are not obligated to monitor every submission.

19. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, payment processors, shipping carriers, analytics services, and social-media platforms.

We do not control all third-party websites, services, policies, content, or availability. Accessing or using a third-party service may be governed by that provider’s separate terms and privacy policy.

Prime Sports is not responsible for losses caused solely by an independent third party except where applicable law provides otherwise.

20. Privacy

Our collection and use of personal information are governed by our Privacy Policy and applicable law.

By using the website, you acknowledge that information may be processed by Shopify and other service providers necessary to operate the store, process payments, prevent fraud, fulfill orders, communicate with customers, and provide store functionality.

Please review the Privacy Policy before using the website or submitting personal information.

21. Electronic Communications

By contacting us, creating an account, or completing a purchase, you consent to receive electronic communications necessary to administer your account or order. These may include confirmations, receipts, shipping notices, security messages, and customer-service communications.

Transactional communications are separate from promotional marketing. Where required, promotional emails or messages will be sent only with appropriate consent and will include an available method for opting out.

22. Disclaimer of Warranties

To the fullest extent permitted by law, the website and services are provided on an “as available” basis.

Where liability cannot be excluded entirely, Prime Sports’ total liability arising from a transaction will not exceed the amount you paid for the product giving rise to the claim, except when applicable law requires a different result.

These limitations do not apply to liability that cannot legally be limited or excluded.

24. Indemnification

To the extent permitted by law, you agree to indemnify and hold Prime Sports harmless from third-party claims, damages, liabilities, and reasonable expenses arising from:

• Your material violation of these Terms

• Your infringement of another party’s rights

• Fraudulent or intentionally harmful conduct performed through your account

This section does not require you to indemnify Prime Sports for its own unlawful conduct.

25. Events Outside Our Control

Prime Sports will not be responsible for a delay or failure caused by circumstances outside our reasonable control.

Such circumstances may include severe weather, natural disasters, fires, carrier disruptions, supply-chain failures, labor disputes, government actions, customs delays, public-health emergencies, power failures, internet outages, cyber incidents, or failures of third-party service providers.

We will make reasonable efforts to communicate material delays and determine an appropriate solution.

26. Suspension and Termination

We may suspend or terminate access to the website or an account if we reasonably believe that a user has violated these Terms, engaged in fraud or abuse, created a security risk, or used the services unlawfully.

Termination does not eliminate payment obligations or other responsibilities arising before termination. Provisions that logically should continue—including intellectual-property, liability, dispute, and indemnification provisions—will survive termination.

27. Governing Law and Courts

These Terms and any dispute involving Prime Sports will be governed by the laws of the State of Oklahoma and applicable federal law, without regard to conflict-of-law principles.

Unless applicable law requires another location, legal proceedings must be brought in a court with proper jurisdiction in Oklahoma.

Either party may bring an eligible claim in small-claims court. Consumers retain the benefit of any mandatory legal protections that apply in their place of residence.

28. Changes to These Terms

We may revise these Terms periodically to reflect changes in our products, practices, technology, or legal obligations.

The updated version will be posted on the website with a revised effective date. Changes will apply prospectively when required by law.

Continuing to use the website after revised Terms become effective constitutes acceptance of those revisions to the extent permitted by law.

29. Severability

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent legally permitted or separated from the remaining Terms.

The remaining provisions will continue in effect.

30. No Waiver

A delay or failure by Prime Sports to enforce a provision does not waive its right to enforce that provision later.

A waiver is effective only when expressly made in writing by an authorized representative of Prime Sports.

31. Entire Agreement

These Terms, together with the policies and notices referenced in them, form the entire agreement between you and Prime Sports regarding use of the website and purchases made through it.

They replace earlier communications or agreements concerning the same subject matter, except for any written agreement expressly stated to remain in effect.
